A new Water Use Efficiency law that has just completed its own court challenges and has just become active which in fact now considers CRP a municipality as far as the water system is concerned.  This is going to both protect us, where our water rights are concerned and also provide us with some challenges as far as service meters for leak detection are concerned.

This new designation may make it easier for us to obtain grants to help us install the 250+ meters we need to install by fall 2016 to be in compliance with this new law.  As a private water system, grants were all but impossible for us to qualify for. The board will be investigating this in the near future.  More information on this will be forthcoming. The end result of this new law is that the associations yearly assessment will have to be increased starting in 2012. The board has known that this new law was coming for several years and we have been working very diligently to install as many service meters we could and still keep the assessment as low as possible. Having to defend the association over the last two years and the fact that the Water Efficiency Rule now has a real deadline are the two main reasons for the assessment increase.

The 2012 assessments will be $540.00 per year for a lot with water and $500.00 for a lot without water. This includes the $50.00 mosquito assessment. If grants are obtained to help us install the needed meters, this assessment may be reduced in 2013. If any owners have grant writing experience and would like to help, please contact the association. Please remember, these meters are for leak detection only. You will not be charged for the amount of water you use.

Dear Fellow Owners:

The Board is taking this opportunity to update you on a few things concerning your community.

Lawsuit Update

On December 15, 2011, the Chelan County Superior Court ruled on the cross-summary judgment motions brought by the Association and the Plaintiffs (a small group of homeowners) on the nightly rental issue. 

The Court found in favor of the Plaintiffs, ruling that the owners have the right to rent their homes and that there was no wording in the original protective covenants that restricted the duration of a rental.

The Board feels that they still have a duty to the 82% majority of owners who voted and who have consistently voiced their opinion that they do not want nightly rentals operating  in their community.  Because of this fact, the Board will appeal the decision of the trial court. Judge Bridges indicated that he does not deal with many covenant cases and, unfortunately, there are no current opinions that specifically address the issue of the operation of vacation rentals in homeowners’ associations.  This area of law needs to be sorted out via the appellate process.  We know that the nightly rental issue has been a hotly debated issue in the community and emphasize that all owners should respect all other owners while this legal process is completed. 

In his oral ruling, Judge Bridges restated the Supreme Court’s view that courts, when dealing with covenant issues, should accommodate the “collective interest” of the community.  It is this “collective interest” that is the basis for the decisions of the current Board of Trustees.  It also has been a ruling factor in our decision-making process over the last four years in dealing with this issue.  Security, quality of life, sense of community and the basic ability of the owners themselves to determine the future of the community is the “collective interest” that rules the roost, so to speak, at every Board meeting.

Lawsuits are never simple or clear cut. The best and most reliable way to obtain information is to contact a current Board member.  They will have the most recent, factual information.  Information you hear at the local hardware store or mini mart may not be true and may be someone’s opinion or uninformed interpretation.

Robberies

We have had a few break-ins over the last few months in the area.  If you see suspicious looking vehicles, people, or activity, please call the sheriff’s department at 663-9911

Snowmobiling

The privilege afforded to us to be able to ride on the county roads is very fragile.  The speed limit is 25 mph. If we abuse it, we will lose it. ATVs are not allowed on County roads. If you see four wheelers on our roads, please contact the sheriff’s department.

Fire Hydrants

Please help us help you by assisting in keeping the snow cleared away from your fire hydrant.

Water Leaks

If you see a spot that is void of snow, with snow everywhere else, please contact Dan so he can check it out and make sure that there is not a leak.

Assessments

The billing for the 2012 assessment will be mailed on January 1,  2012.  The first half of the assessment and the entire mosquito bill are due March 1, 2012.  Letters regarding water discontinuation for the failure to pay the special assessment will also be mailed on January 1, 2012 and water will be terminated to those who have not paid this assessment or contacted the Association by January 10, 2012.

Board of Trustees

State Laws:

All ATVs must be titled and registered, with owners receiving an Off-Road Vehicle use permit and ORV tag to place on their ATV, unless used solely on agricultural lands owned or leased by the ATV owner or operator.

ATVs shall not be operated between dusk and dawn without a lighted taillight and headlight.

No one under age 13 may operate an ATV on or across a highway or road except on a road designated for off-highway vehicle use under direct supervision of a person at least 18 who has a driver’s license.We do have special permission to ride snowmobiles, It is not legal to ride 4-wheelers on our county roads.

Our roads are designated for snowmobilie use but no other type of ORV. 

We don’t want to lose that privilege.
